By utilizing or entering the Platform every User consents to comply with the Terms & Conditions outlined below.

  1. 1. 1 By entering or utilizing the Platform, all Users. Consent to comply with the terms outlined herein, which may be updated periodically.
  1. 1. 2 Any unauthorized use, misapplication, bypassing of security measures, data retrieval, sharing of accounts or breach of system security will lead to termination without refund and could result in civil or criminal prosecution according to relevant laws.
  1. 1. 3 DW-SME reserves the right to revoke, suspend or end any subscription, account, contract or license at its discretion and, without advance notification if any breach occurs.
  1. 1. 4 All subscriptions, payments, purchases, and fees are strictly non-refundable under all circumstances.
  1. 1. 5 No User is permitted to copy, download, replicate, share, send, save, broadcast, exhibit, translate, publish, resell or distribute through any method any material or information owned by DW-SME in any format.
  1. 1. 6 Users by proceeding with the use of the Platform automatically agree to all changes, revisions or enhancements to these Terms.
  1. 2. STUDENT TERMS
  1. 2. 1 Subscription, Access & License Grant
  1. 2.1. 2 Subscription access ends automatically. Cannot be extended, paused, frozen, transferred or refunded.
  1. 2.1. 3 Users recognize that technical disruptions might occur because of system upkeep, hosting services or network circumstances. Consequently these disruptions do not grant Users eligibility for refunds or extensions.
  1. 2. 2 Retention of Learning Data
  1. 2.2.1. DW-SME is capable of saving the Users data, which includes but is not restricted to, notes, analytics, progress records, flashcards and bookmarks for later reaccess using the identical email address registered.
  1. 2. 3 Usage Restrictions

Notice: Students are expressly forbidden from:

  1. Sharing login credentials with any person or institution
  2. screen-recording, screenshotting, downloading, saving, copying or exporting platform content
  3. Through sharing DW-SME content via WhatsApp, Telegram, Facebook, PDFs, drive links, recordings, websites, apps or any social media platform.
  4. Using VPNs, proxies, falsified IPs, automation scripts, bots or scraping/capturing applications to access the Platform.
  5. using the Platform for group teaching, coaching, academy instruction, or batch preparation

Any violation is intellectual property theft and a material breach of these Terms.

  1. 3. TUTOR & ADMIN TERMS
  1. 3. 1 Intellectual Property Rights in All Sessions
  1. 3.1. 1 All lectures, sessions, courses, classes, meetings, recordings or materials delivered through the email, domain, platform or digital assets of DW-SME shall be deemed the sole intellectual property of DW-SME regardless of any contractual agreements, except when a different arrangement is specified in a written and signed contract.

unless explicitly stated in a signed written agreement this occurs without advance notification or extra payment.

  1. 3. 2 Content Creation Responsibility

Tutors/Admins must:

Distinctive and authentic content; Should rely exclusively on information derived from established textbooks and official guidelines.

Make certain that every MCQ, explanation, note, PDF, diagram and video is a creation.

  • Refrain, from copying or replicating copyrighted question collections or premium materials.
  1. 3. 3 Copyright Liability
  1. 3.3. 1 Each tutor/admin holds legal accountability, for any copyrighted content they provide.
  1. 3.3. 2 DW-SME will not be responsible. Will not participate in any claim initiated by a copyright owner.
  1. 3.3. 3 DW-SME is authorized to enforce sanctions, close accounts or agreements and notify appropriate authorities about offenders if required.

Reports are required to contain:

  • Source reference, exact
  • screenshots
  • verifiable proof
  • Page/Chapter Information

4. 2 Upon confirmation of the report the DW-SME will:

  • Remove the violating content without delay.
  • conduct an inquiry
  • The imposition of fines on the individual responsible

Minimum internal penalty:

US$1,000 for every 100 words of copyrighted material.

5. PENALTIES FOR UNAUTHORIZED SHARING OF DW-SME CONTENT

If any User. Student, tutor, admin or employee. Distributes any DW-SME material without written consent, on company letterhead bearing the stamp and signatures of the CEO and Directors the ensuing sanctions will be enforced:

  • 500 USD, per MCQ provided
  • $1,000 USD, for each explanation or valuable insight provided

6. DATA USE, COMMUNICATION & MARKETING CONSENT

6. 1 Every User agrees to the utilization of their data, for the purpose of:

  • Internal analytics and performance tracking
  • advertisements and marketing campaigns
  • updates, on programs and products
  • Enhancing the user experience.

6. 3 Data shall be disclosed solely to carefully chosen, contractually obligated service providers and partners for technical, security and marketing objectives and only in a way that aligns with these Terms.

7. SECURITY OF INTERNAL MATERIALS

A minimum penalty of USD 10,000 will be imposed for each instance of unauthorized disclosure, reproduction, or external dissemination, in addition to any additional damages and remedies that may be available.

8. INTELLECTUAL PROPERTY RIGHTS

8. 1 Every piece of material developed inside or on behalf of DW-SME, such, as MCQs, explanations, diagrams, notes, videos, animations, scripts and recordings is solely the property of DW-SME.

8. 2 Users shall not:

  • claim ownership
  • sublicense
  • resell
  • republish
  • distribute
  • upload
  • translate
  • adapt or create derivative works
  • for any commercial purpose whatsoever

without a written contract signed and stamped by DW-SME, Chief Executive Officer, and Directors.

9. TERMINATION RIGHTS

DW-SME reserves the absolute right to:

  • Terminate accounts
  • disable access
  • remove tutors/admins
  • enforce sanctions
  • initiate action

in the event of any suspected or confirmed violation, at its sole discretion, without prior notice or reimbursement.

10. TECHNICAL LIMITATIONS

Users understand that:

  • maintenance, technical disruptions and periods of inactivity might take place.

System problems are not a basis for refunds, extensions, or damages.

  • DW-SME will not be held responsible for device malfunctions internet connection or technical issues, on the users end.

Ongoing utilization of the Platform implies agreement, to all changes.

12. LICENSE & PERMITTED USE (UWorld-Equivalent Clauses)

12. 1 Users receive a licence solely, for personal study purposes.

12. 2 Users shall not:

  • Utilize the Platform in classrooms, academies, or coaching centers
  • project or broadcast DW-SME content to groups

Access through VPNs, anonymizers, or unauthorized networks in a manner intended to hide identity or location

  • Scrape, crawl, index, mirror or archive content

12. 3 Utilizing for multi-user applications necessitates a distinct contract, with DW-SME.

13. 1 Users are prohibited from using:

  • bots
  • AI models
  • automation scripts
  • browser extensions
  • scraping tools
  • developer-tools extraction workflows
  • Any other automated mechanism

to access, store, translate, replicate, or reproduce any DW-SME content.

14. HONOR CODE

14. 1 The user commits to refraining from:

reproduce MCQs, explanations, or notes from memory for the purposes of sharing.

  • Reproduce DW-SME content systematically on any other platform or medium
  • disclose any material during or following the end of the subscription period

14. 2 Engaging in conduct violates academic integrity and intellectual property regulations. Consequences will be enforced as detailed in these Terms with fines of no than USD 500 for each MCQ and USD 1,000, for each explanation and/or high-yield point.

15. PROHIBITION OF ACADEMY/GROUP USE

15. 1 Student licenses cannot be. Are prohibited from being used:

  • to teach classes
  • in groups or batches
  • in coaching centers or academies
  • as a shared resource in any educational institution

15. 2 Any unauthorized use by an institution or group results in a fine of US $50,000 per batch or group along, with termination and potential legal proceedings.

16. DEVICE & LOCATION SECURITY

  • device fingerprints
  • IP addresses
  • login patterns
  • geolocation approximations

16. 2 DW-SME might automatically block, limit or end access if suspicious or irregular activity is identified.

17. PROHIBITION OF REAL EXAM CONTENT

Users such, as tutors, administrators and question bank developers are prohibited from uploading, distributing or integrating exam questions from CPSP, JCAT, EMREE, MRCP, PLAB, USMLE, DHA, HAAD, MOH or any other examination governing body.

Engaging in any actions is completely forbidden, with full legal accountability lying exclusively with the offender. DW-SME firmly. Neither supports nor permits these unlawful acts.

DW-SME reserves the right to:

  • revoke the Users access
  • collaborate with. Inform the appropriate examination authority, about the offender if considered necessary.

18. NO REFUNDS, NO EXTENSIONS, NO PRORATION

All payments are final.

  • unused time
  • dissatisfaction with content or performance

Technical problems or maintenance periods.

19. PURCHASE FRAUD, CHARGEBACKS & PAYMENT REVERSAL

19. 1 Any deceptive chargeback, contention or demand, for payment reversal regarding a purchase will result in:

  • immediate termination of all accounts linked to the User
  • permanent ban from all DW-SME services
  • legal recovery action for all outstanding amounts

19. 2 DW-SME will have the right to receive the subscription fee along with an administrative penalty of up to USD 5,000 in addition, to the expenses incurred in disputing the chargeback.

20. VIDEO & RECORDING RESTRICTIONS

Users may not:

  • Record video content
  • download or decrypt media streams
  • Capture or export subtitles
  • employ any type of screen recording software or virtual webcam to duplicate material

21. IMPROPER USE OF NAME, TRADEMARK OR MATERIALS

  • Impersonate staff, management, or official representatives of DW-SME
  • Utilize DW-SME's name, logo, or other brand assets in personal, commercial, or academic promotion.
  • advertise, offer courses or market services using the DW-SME name or materials without obtaining written consent

Violators may be subject to civil claims and contractual penalties, not less than USD 50,000 per incident.

22. 1 DW-SME content shall not be utilized to:

  • Train AI models or LLMs
  • Seed or generate other question banks
  • benchmark or test AI systems

22. 2 Penalty for violation: Minimum USD 50,000 and/or DMCA takedown actions, PECA 2016 proceedings along with other available remedies.

23. SURVEILLANCE & SECURITY AUDITING

Users explicitly agree to surveillance for:

  • abnormal, or high-volume access
  • Suspicious download patterns
  • multiple rapid device switches

24. GOVERNING LAW & DISPUTE RESOLUTION

24. 1 These Terms shall be governed by the framework of the Islamic Republic of Pakistan encompassing but not limited to:

  • The Copyright Ordinance, 1962
  • The Companies Act, 2017
  • The Prevention of Electronic Crimes Act (PECA), 2016

24. 2 Without affecting DW-SME's right to initiate or defend proceedings in any other appropriate venue as required (including foreign courts where the defendant or assets reside), Pakistani courts will have the authority to decide civil and criminal cases involving DW-SME in favor of courts with territorial jurisdiction over its registered office.

24. 3 Users hereby relinquish any entitlement to initiate or take part in a class-action or collective lawsuit, against DW-SME.

25. NON-COMPETE & NON-DERIVATIVE WORKS (FOR TUTORS/ADMINS)

25. 1 Tutors/Admins recognize that for a duration not exceeding forty-eight (48) months following the end of their association, with DW-SME they shall refrain from:

  • Use DW-SME content or internal strategies to create a substantially similar competitive product

25. 2 Except when permitted in writing any derivative works derived from the content of DW-SME are forbidden.

Note: the true enforceability and length of the -compete commitments rely on the relevant laws and the courts assessment of reasonableness.

26. FAMILY/FRI

26. 1 Accounts are personal non-transferable. Under no circumstances may it be disclosed to spouses, siblings, friends, coworkers, or any other third party.

26. 2 Shared access or unauthorized third-party use will lead to termination and may result in applicable fines and claims.

27. DIGITAL FORENSICS CLAUSE

DW-SME might look into content breaches or misuse of the system by inspecting, gathering and safeguarding:

  • access logs
  • IP history
  • Device IDs and fingerprints
  • Timestamps
  • activity trails

Users agree to these methods as a prerequisite, for usage.

28. VERIFICATION OF IDENTITY

Declining or not completing identity verification can lead to prompt dismissal. If applicable legal proceedings, in instances of fraud or deceit.

29. LIMITATIONS ON PLATFORM ACCESS

At the discretion of DW-SME:

  • suspend access to all or part of the Platform
  • Perform maintenance or upgrades
  • Restrict capabilities. Evaluate new platforms

These actions may occur with or, without warning and do not justify Users asking for refunds, extensions or any form of compensation.

30. INDEMNITY

30. 1 Users agree to indemnify, defend and protect Dr. Wasim School of Medical Education (DW-SME) along with its CEO, Directors, employees, tutors, affiliates, contractors and service providers, against any and all claims, damages, losses, liabilities, penalties, costs or expenses resulting from:

  1. improper use or distribution of the DW-SME content
  2. breach of these Terms and Conditions
  3. use of the Platform in violation of applicable laws
  4. . Distributing content that is copyrighted, unlawful or forbidden.
  5. Any behavior, procedure or action that negatively impacts the systems, servers, brand and/or intellectual property of DW-SME
  6. Fraudulent payments, disputes, chargebacks, or misrepresentations

30. 2 This indemnification duty remains effective beyond the end of the Users subscription and/or account. Any financial penalties will be enforced as, per the penalty framework detailed in these Terms, where including Clauses 4 5 7 13 15 19 20 21 and 22.

31. LIMITATION OF LIABILITY

31. 1 far as the law allows DW-SME will not be responsible, for:

  1. Any damages that are incidental, consequential, exemplary, punitive, or indirect
  2. A decrease in earnings, income, goodwill, or commercial prospects
  3. data loss, account loss, or technical interruption
  4. reliance on DW-SME content for exam performance or career outcomes
  5. user-side internet, device, or technical issues

31. 2 DW-SMEs overall aggregate liability for any claim regardless if it arises from contract, tort, negligence or other causes shall be limited to the sum paid by the User for their current subscription, in the most recent billing period.

31. 3 Users recognize that DW-SME offers educational material and does not hold responsibility for

  • job placements
  • the precision or thoroughness of memory- exam material provided by students when applicable requested
  • decisions of the exam authority

32. DMCA & IPO TAKEDOWN PROCESS (COPYRIGHT COMPLIANCE)

32. 1 DW-SME adheres to all intellectual property regulations. These regulations encompass the Copyright Ordinance 1962 PECA 2016 DMCA guidelines and the IPO Pakistan trademark framework.

32. 2 Should you consider that any part of the DW-SME material violates your copyright or trademark forward a written removal request, to:

Subject: DMCA/IPO Takedown Request

Your notification should contain:

  1. Full legal name and contact information
  2. Proof of ownership: registration, screenshots, ISBN, URL, trademark certificate, etc.
  3. Clear description of infringed content
  4. Location of the infringing material on the DW-SME Platform
  5. Sworn statement confirming the notification is accurate. Submitted sincerely

32. 3 Upon receipt of a valid notice, DW-SME shall:

  • evaluate the claim • deactivate the content • notify the uploader 32.4 DW-SME holds the authority to permanently delete the content deactivate the account and dismiss the tutors/staff in case of single or multiple violations. To the extent permitted by law DW-SME will not be held responsible, for any infringing material posted by Users. The uploader/offender shall assume legal liability and repercussions and this shall not affect DW-SMEs rights or protections. 32.5 False DMCA notices are punishable, under the PECA 2016 and applicable legislation.

33. COOKIES POLICY & TRACKING TECHNOLOGY

33. 1 DW-SME employs cookies and tracking technologies for purposes including:

  • authentication
  • device security
  • performance analytics
  • personalization
  • fraud detection
  • marketing and retargeting
  • subscription verification

33. 2 By accessing the Platform Users consent to the storage, processing and analysis of cookie information.

33. 3 Users may disable cookies via browser settings; however doing so might. Hinder the Platforms features.

33. 4 DW-SME may use analytics and advertising services, including but not limited to Google Analytics, Meta Pixel, TikTok Pixel, and comparable tools, as long as these activities strictly adhere to security and privacy regulations.

34. E-SIGNATURE & ELECTRONIC CONSENT

34. 1 Users acknowledge that:

  • selecting "I Agree "
  • registering an account
  • settling a payment or
  • engagement, with the Platform

represents a legitimate and legally enforceable electronic signature. 34.2 Users waive any claim that these Terms require physical signatures to be binding. 34.3 Electronic records stored by DW-SME—including logs, timestamps, device IDs, and IP addresses—are admissible under Pakistani law to serve as evidence, including: • Qanun-e-Shahadat 1984 • PECA 2016 • The Electronic Transactions Ordinance 34.4 All agreements, notices, records, and communications provided electronically hold the same legal effect as physical documents.
